1. Agreement to Terms

BY ACCESSING OR USING PETIT TALES, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS OF SERVICE. IF YOU DO NOT AGREE, DO NOT USE THE SERVICE.

If you are using the Service on behalf of a minor child, you agree to these Terms on your behalf and on behalf of such minor.

1.1 Eligibility

You must be at least 18 years of age to create an account. By creating an account, you represent and warrant that you are at least 18 years old.

Children under 13 may NOT create accounts or use the Service directly. The Service is designed for parents and legal guardians to create personalized stories for their children.

1.2 Modification of Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or prominent notice in the app. Your continued use after such changes constitutes acceptance of the modified Terms.

2. Description of Service

Petit Tales is an AI-powered bedtime story application that creates personalized, ongoing narratives for children. The Service uses artificial intelligence technology (Claude AI by Anthropic) to generate story content based on child profile information provided by parents or legal guardians.

2.1 Subscription Tiers

  • Free: $0/month - 3 story chapters, 1 child profile, up to 5 family members
  • Basic: $6.99/month - Unlimited chapters, 1 child profile, up to 5 family members
  • Family: $12.99/month - Unlimited chapters, up to 4 child profiles, up to 5 family members

2.2 Service Availability

We strive to provide continuous service availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

3. AI-Generated Content Disclaimers

ALL STORY CONTENT IS GENERATED BY ARTIFICIAL INTELLIGENCE

The stories provided through Petit Tales are created using artificial intelligence technology (Claude AI developed by Anthropic). AI-generated content is created by machine learning models and may contain errors, inaccuracies, or unexpected outputs.

3.1 You Acknowledge and Agree That:

  • AI-generated content is NOT reviewed, edited, or approved by humans before delivery to you;
  • AI-generated content may contain factual errors, inconsistencies, or nonsensical passages;
  • The quality, appropriateness, and suitability of AI-generated content cannot be guaranteed;
  • AI models may produce different results for similar inputs;
  • We have no control over the specific creative choices made by the AI in generating story content.

3.2 Parental Review Required

YOU ARE SOLELY RESPONSIBLE for reviewing all AI-generated story content before sharing it with or reading it to your child.

We strongly recommend that parents and guardians:

  • Read each chapter in full before presenting it to a child;
  • Assess whether the content is appropriate for your specific child's age, maturity, and sensitivities;
  • Use the feedback feature to report any concerning content;
  • Discontinue use if content does not meet your standards.

PETIT TALES IS NOT A SUBSTITUTE FOR PARENTAL JUDGMENT. You assume full responsibility for determining the appropriateness of any content shared with your child.

3.3 Potential Issues with AI Content

You acknowledge that AI-generated content may:

  • Contain themes or elements that some users find objectionable;
  • Include inaccurate information or impossible scenarios;
  • Deviate from expected story arcs or character development;
  • Inadvertently reference real persons, places, or events;
  • Produce content that is repetitive or inconsistent;
  • Fail to properly incorporate your specified preferences or themes;
  • Contain stereotypes or biases present in training data;
  • Include content that may be frightening or disturbing to some children despite age-appropriate targeting.

3.4 No Warranties on Content

WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE ACCURACY, COMPLETENESS, RELIABILITY, APPROPRIATENESS, EDUCATIONAL VALUE, OR SUITABILITY OF AI-GENERATED CONTENT FOR ANY PARTICULAR CHILD OR AUDIENCE. AI-GENERATED CONTENT IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND.

3.5 Intellectual Property of AI Content

Subject to your compliance with these Terms, you are granted a non-exclusive, non-transferable license to use AI-generated stories for personal, non-commercial use only.

You may:

  • Read stories to your children;
  • Share stories within your immediate family;
  • Print stories for personal use.

You may NOT:

  • Publish, distribute, or sell AI-generated content;
  • Claim authorship of AI-generated content;
  • Use AI-generated content for commercial purposes;
  • Use the Service to generate content for purposes other than children's bedtime stories.

4. User Accounts and Responsibilities

4.1 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use.

4.2 Prohibited Conduct

You agree NOT to:

  • Use the Service for any unlawful purpose;
  • Attempt to bypass or circumvent any access controls;
  • Use the Service to generate content for anyone other than your own children or children for whom you have legal guardianship;
  • Provide false information about children's ages or characteristics;
  • Share account credentials with others;
  • Use automated means to access the Service;
  • Attempt to reverse engineer the AI systems;
  • Use the Service to train competing AI models.

4.3 Account Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms. Upon termination for cause, no refund will be provided.

5. Payment Terms

5.1 Merchant of Record

All payments for Petit Tales subscriptions are processed by Paddle.com Market Limited ("Paddle"), which acts as the Merchant of Record for all transactions. By making a purchase, you agree to Paddle's Checkout Buyer Terms available at: https://www.paddle.com/legal/checkout-buyer-terms

Paddle is responsible for:

  • Payment processing and security
  • Tax calculation and remittance
  • Refund processing
  • Currency conversion
  • PCI compliance

5.2 Subscription Billing

Subscriptions automatically renew at the end of each billing period unless cancelled. You authorize us to charge your payment method on file for each renewal period.

5.3 Cancellation and Refunds

You may cancel your subscription at any time through your account settings or by contacting Paddle directly. Upon cancellation:

  • Your subscription will remain active until the end of the current billing period;
  • No partial refunds are provided for unused portions of a billing period;
  • Your child profiles and stories will remain accessible until the subscription end date;
  • After expiration, your account will revert to Free tier limitations.

Refund requests must be directed to Paddle as the Merchant of Record.

6. Limitation of Liability

6.1 Disclaimer of Warranties

THE SERVICE AND ALL CONTENT, INCLUDING AI-GENERATED STORIES, ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO: IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY OR COMPLETENESS OF CONTENT, SUITABILITY FOR ANY PARTICULAR CHILD OR AUDIENCE, UNINTERRUPTED OR ERROR-FREE SERVICE, AND SECURITY OF DATA TRANSMISSION OR STORAGE.

6.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PETIT TALES, ITS OPERATOR EDUARDO JAVIER SERRA LENTI, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY: (A) INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES; (B) LOSS OF PROFITS, REVENUE, DATA, OR USE; (C) BUSINESS INTERRUPTION; (D) COST OF SUBSTITUTE SERVICES; (E) EMOTIONAL DISTRESS, DISAPPOINTMENT, OR PSYCHOLOGICAL HARM; (F) DAMAGES ARISING FROM AI-GENERATED CONTENT; (G) DAMAGES RESULTING FROM SERVICE INTERRUPTIONS OR DOWNTIME; (H) DAMAGES ARISING FROM UNAUTHORIZED ACCESS TO YOUR ACCOUNT; (I) ANY OTHER DAMAGES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY. THIS APPLIES REGARDLESS OF WHETHER WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

6.3 Liability Cap

IN JURISDICTIONS THAT DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNTS PAID BY YOU TO US IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE CLAIM; OR (B) ONE HUNDRED EUROS (€100). THIS LIMITATION APPLIES TO ALL CAUSES OF ACTION IN THE AGGREGATE.

6.4 AI-Specific Liability Disclaimer

WITHOUT LIMITING THE FOREGOING, WE SPECIFICALLY DISCLAIM ALL LIABILITY FOR:
  • Any harm, distress, or adverse effect on any child resulting from exposure to AI-generated content;
  • Content that a parent/guardian deems inappropriate after review;
  • Content that a parent/guardian fails to review before sharing;
  • Any reliance on factual statements within AI-generated stories;
  • Disappointment with story quality or narrative direction;
  • Failure of AI-generated content to match expectations or preferences;
  • Any alleged infringement of third-party intellectual property rights in AI-generated content.

YOU ASSUME ALL RISK ASSOCIATED WITH AI-GENERATED CONTENT.

6.5 Essential Purpose

You agree that the limitations of liability set forth herein are essential to the agreement between you and Petit Tales, and that Petit Tales would not provide the Service without such limitations.

7. Indemnification

YOU AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS PETIT TALES, ITS OPERATOR EDUARDO JAVIER SERRA LENTI, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, AND LICENSORS FROM AND AGAINST ANY AND ALL CLAIMS, DAMAGES, LOSSES, COSTS, AND EXPENSES (INCLUDING REASONABLE ATTORNEYS' FEES) ARISING FROM OR RELATING TO:
  • Your use of the Service;
  • Your violation of these Terms;
  • Your violation of any rights of any third party;
  • Your sharing of AI-generated content with minors without appropriate review;
  • Any content or information you provide through the Service;
  • Your failure to comply with applicable laws;
  • Any claim that your use of the Service caused harm to any person.

8. Dispute Resolution

8.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Italy, without regard to its conflict of law principles.

8.2 Binding Arbitration

YOU AND PETIT TALES AGREE THAT ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL BE RESOLVED BY BINDING ARBITRATION, RATHER THAN IN COURT.

This includes disputes arising from AI-generated content, service quality, or any other aspect of your use of the Service.

Exceptions:

  • Either party may bring claims in small claims court;
  • Either party may seek injunctive relief in Italian courts for intellectual property violations.

8.3 Class Action Waiver

YOU AND PETIT TALES AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

Unless both parties agree otherwise, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.

8.4 Time Limitation

Any claim or cause of action arising out of or related to the Service or these Terms must be filed within one (1) year after such claim or cause of action arose, or be forever barred.

9. Apple App Store Terms

If you access the Service through an iOS application, the following additional terms apply:

  • These Terms are between you and Petit Tales only, and not with Apple Inc. ("Apple"). Apple is not responsible for the Service or its content.
  • Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Service.
  • In the event of any failure of the Service to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the app (if any). To the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the Service.
  • Apple is not responsible for addressing any claims by you or any third party relating to the Service or your possession and use of the Service, including: (i) product liability claims; (ii) any claim that the Service fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection or similar legislation.
  • Apple is not responsible for the investigation, defense, settlement, or discharge of any third-party claim that the Service infringes that third party's intellectual property rights.
  • You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and you are not listed on any U.S. Government list of prohibited or restricted parties.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right to enforce these Terms against you as a third-party beneficiary.
  • You must comply with applicable third-party terms of agreement when using the Service.

10. Google Play Store Terms

If you access the Service through an Android application, the following additional terms apply:

  • These Terms are between you and Petit Tales only, and not with Google LLC ("Google"). Google is not responsible for the Service or its content.
  • Your use of the Service must comply with Google Play's current Terms of Service.
  • Google is not a party to these Terms and has no responsibility for the Service or content.
  • Google has no obligation to provide maintenance or support for the Service.
  • Google is not responsible for addressing any claims relating to the Service.

11. Miscellaneous

11.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Petit Tales regarding your use of the Service.

11.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

11.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

11.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms freely without restriction.

11.5 Force Majeure

We shall not be liable for any failure to perform due to causes beyond our reasonable control, including but not limited to: acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemic, strikes, shortages of transportation, fuel, energy, labor, or materials, or failures of AI service providers.
